Access to and navigation on this website are subject to these General Terms and Conditions of Use, which incorporate the General Terms and Conditions of Sale of the online store www.boomfit.com and the Privacy Policy presented on the page titled "Privacy Policy" provided by the commercial company World Fit Online, Lda, NIPC 513968482, headquartered at Rua Padre Avis de Brito, 189, 4760-234, Vila Nova de Famalicão, Portugal, hereinafter referred to as BOOMFIT, in reference to the registered trademark it owns.

The purpose of these General Terms and Conditions of Use is to define the conditions for accessing and browsing the website by customers who wish to make purchases in the online store. The General Terms and Conditions of Sale aim to regulate the terms governing commercial transactions between BOOMFIT and the Customer. The Privacy Policy aims to identify privacy protection measures regarding the processing of personal data and the free movement of data pertaining to natural persons, including tools for the personalized management of personal data provided by customers.

1. Commercial Policy

Our commercial policy is based on strict compliance with applicable laws and regulations. All transactions are conducted securely and discreetly, and all data is stored securely.

2. How to Order

2.1 Steps to complete a purchase in the online store

  • Select the desired product and add it to the shopping cart;
  • Follow the checkout instructions to fill in the order details;
  • Select your preferred payment method;
  • Confirm your order details;
  • Complete the payment;
  • The product will be shipped to the address provided.

2.2 Right to Refuse the Order or Cancel the Purchase

We reserve the right to refuse the order or cancel the purchase at any time and for any reason. A full refund will be issued if the order is canceled before shipment. If the order has already been shipped, the refund will be issued after the product is returned in perfect condition.

2.3 Data verification

The personal data provided at the time of ordering is verified to ensure that the order is processed securely. The customer is responsible for providing accurate and complete information. If the information provided is incomplete, incorrect, or unverifiable, the order may be canceled.

 

3. Warranties and Product Pricing

All products come with a quality guarantee for a minimum period of 1 year. Product prices include all applicable taxes.

3.1 Payment Methods

We accept payments via bank transfer, credit card, PayPal, Multibanco, Mbway, Klarna, and other payment methods. The payment method must be selected at the time of ordering. Credit card payments are processed securely through our payment partner, as are all other payments. We do not store any credit card information or information regarding any other payment method

3.2 Payment Processing

Payment is processed automatically as soon as the order is confirmed. Payment must be processed successfully for the order to be fulfilled. If payment is not processed successfully, the order will not be shipped and the order amount will be refunded. In the case of credit card payments, all details (e.g., card number or expiration date) will be sent via an encrypted protocol to the company providing remote electronic payment services, without third parties having access to the transmitted information

4. Order Security

All of our payment providers are certified, and order data is transmitted securely in accordance with the latest security protocols. Payments are processed securely, and all data is stored securely.

 

5. Retention of Title

The products ordered remain subject to our retention of title until full payment has been received.

 

6. Prices

All prices shown on our website include VAT at the current rate. Prices are valid for online orders and are valid on the date of the order. We reserve the right to change prices at any time without prior notice.

6.1 Total Price at Checkout

The total price at checkout is the total price of the products plus shipping costs and any applicable taxes. The total price of the order will be displayed before you confirm the order.

6.2 Pricing Errors

We reserve the right to correct any pricing errors, including incorrect prices on our website, which may arise due to human error, computer system malfunctions, or any other situation. If an incorrect price is displayed, we will inform the customer before shipping the order, and we will not proceed with the order until the price is corrected.

7. Quality and Warranty

All products come with a 3-year quality warranty. The costs of repairing or replacing any defective product will be borne by the company during this period. After the warranty period expires, the costs of repair or replacement will be borne by the customer.

 

8. Shipping & Delivery

Our products are shipped via DHL with a tracking number to ensure security and fast delivery. Shipping costs are calculated based on the recipient’s location and must be paid by the customer.

8.1 Delivery: Where and When

Products are delivered throughout the European Union. 

Delivery times vary depending on the destination country. The DHL tracking number will be provided as soon as the order is shipped. The customer must check the order status with DHL to confirm the delivery date.

8.2 Delivery Times

Delivery times are the responsibility of the carrier. If your shipment does not arrive within 10 days of the estimated delivery date, you should contact the carrier or our customer support. The carrier or our customer support can initiate an investigation for lost items.

Please note that standard delivery times may vary depending on the product and the origin/destination; ranging from 1–3 days for countries neighboring the country of shipment (Portugal) to up to 20 days for distant countries. Delays of up to 10 days are, unfortunately, possible due to factors such as weather conditions, customs procedures, or operational delays.

8.3 Inspection upon Delivery

The customer must inspect the product upon delivery. If the product is damaged or in poor condition, the customer must accept the product and contact customer service for further information. Photographs of the packaging and the product must be provided.

9. Shipping Rates

Shipping fees are calculated based on the recipient’s location.

9.1 Free Shipping

Free shipping applies to orders above the specified amount and to the listed countries.

10. Returns & Cancellations

We accept returns within 14 days of product delivery. The returned product must be in perfect condition and unused. The cost of return shipping is the customer’s responsibility. A refund for the product’s value will be issued within 7 days of receiving the return.

If the reason for returning the order was due to BOOMFIT’s fault, we will reimburse the respective shipping costs (e.g., defective products or items different from those actually ordered).

The customer may choose to receive a bank refund or a refund voucher that can be used on a future order. The voucher will be valid for 12 months from the date of issuance. After this period, no refund will be issued. 

However, if, in an order containing multiple products, only one has presented a problem, we will not refund the shipping costs.

If the reason for the failed delivery and return of the order is the responsibility of the carrier, regardless of the chosen payment method, the customer must contact Boomfit so that we can resolve the situation with the carrier. 

10.1 Order Cancellation Before Shipping

We reserve the right to cancel the order at any time prior to shipment. If this occurs, the order amount will be refunded to the customer within 7 days.

10.2 Return of defective products

Defective products must be returned to our store. The cost of the return will be covered by the store. Defective products will be repaired or replaced, or the amount paid will be refunded. The quality guarantee is valid for a period of 3 years.

10.3 Returns of products due to buyer’s remorse

Products returned due to buyer’s remorse must be in perfect condition and unused. The cost of return shipping is the customer’s responsibility. The refund will be issued within 7 days of receiving the returned item.

Returns of incomplete, damaged, or scratched products, as well as products without their packaging or products showing signs of use, will not be accepted.

If we receive an item in the conditions mentioned above, the customer will lose the right to a refund and will have 10 days to collect the item(s) from our facilities. The customer may also request a new shipment, in which case they will bear all shipping costs.  

10.4 Return Information

To return a product, the customer must contact customer service. 

Returned products must be sent to the provided address, indicating the order reference or invoice number. A refund for the amount paid will be issued within 7 days of receiving the return.

12. Terms and Conditions for Promotional Codes (Discounts)

Promotional codes and discounts are valid for a limited time and are subject to specific terms and conditions set by the Store

13. Availability

Fulfillment of all orders placed on the website is subject to availability. All orders will be processed as soon as the requested products are available.

14. Promotion Validity

Offers on the website are valid only at the time they are displayed on the website. Prices and discounts shown on the website are subject to change without notice.

15. Liability

We are not liable for any damages or losses caused by the use or misuse of our products.

16. Bodytone Products - Delivery and Warranty 

Bodytone products have a delivery time of approximately 2 to 15 business days. On-time delivery is not guaranteed and is the responsibility of the Bodytone supplier. All these products are shipped directly from our partner Bodytone’s warehouse via the carrier selected by them.

Bodytone products come with a 3-year quality warranty. They are presented on our website divided into the Pro line (intended for professional use) and the Home line (intended for home use). The use of Home line machines in a professional context voids the warranty.

Incidents and complaints are reported to Bodytone, and resolution may take up to 15 business days.

These Terms and Conditions are governed by the laws in force in Portugal.

18. Changes to the Terms & Conditions

We reserve the right to change the Terms and Conditions of Sale at any time, without prior notice.

The information on the website may contain errors, be incomplete, or be incorrect. We reserve the right to change, correct, or update the information on the website at any time, without prior notice.

20. Alternative Dispute Resolution

In the event of a dispute, customers are encouraged to contact our customer service to attempt to resolve the issue. If the issue cannot be resolved, we encourage customers to use an alternative dispute resolution service.
